Who is allowed to advise you

In the UK it is a criminal offence to provide immigration advice or services unless you are regulated. Regulated advisers are either registered with the Immigration Advice Authority (formerly the OISC), or are solicitors, barristers or chartered legal executives regulated by their own professional body.

When you should get regulated advice

  • · A previous visa refusal, overstay or breach of conditions.
  • · A criminal record or any question about good character.
  • · Complex family or dependant circumstances.
  • · Any appeal, administrative review or judicial review.
  • · A sponsor licence problem affecting your job offer.

Warning signs

  • · Anyone guaranteeing a visa outcome.
  • · Anyone asking you to submit false documents or misstate funds.
  • · An "agent" who will not tell you their regulator or registration number.
  • · Fees demanded in cash with no written client-care letter.
